Illinois Workers’ Compensation Insurance System Overview
Learn the ins and outs of how insurance companies operate in Illinois. This module covers the technical aspects of insurance in Illinois including how insurance underwriters determine the premium employers pay and what factors drive up the cost of a workers’ compensation insurance policy.
Legal Module 1: Introduction to Illinois Workers’ Compensation Act and Determining What Constitutes a Compensable Accident.
In this module, we first give a historical perspective as to what prompted the creation of the Act and what is the underlying purpose of the Act. We then explain the nuts and bolts of when the Act applies, for whom it covers and when Illinois has jurisdiction to hear a claim for an injured employee. From this point, we move on to a discussion as to the elements required for a compensable work accident under the Act, including the requirements that the accident “arise out of” and “in the course of” the employment, that the employee have a definable “date of accident,” and that proper notice of the accident is provided to the employer within a set number of days following the accident.
Legal Module 2: Interim Benefits
With module 2, we begin discussing the interim benefits to which an employee is entitled once it is established that he or she has had a compensable work accident. There is a discussion as to how the average weekly wage (AWW) is determined for the employee and the importance of this calculation in determining the payment of benefits. The various interim benefits, including medical benefits, vocational rehabilitation benefits, temporary disability benefits and maintenance benefits are discussed as well.
Legal Module 3: Permanent Benefits
Moving along to module 3, we outline a discussion of the various permanent benefits that are available to injured employees, depending upon the nature and extent of the injuries sustained. This discussion includes a summary of disfigurement benefits, permanent partial disability benefits, wage differential benefits, permanent total disability benefits and death benefits.
Legal Module 4: Additional Remedies and Practice and Procedure before the IWCC
Finally, in module 4, we outline some of the additional remedies available to employees, including a discussion of various penalties that may be awarded along with awards of attorneys’ fees, as well as some limited “remedies” that are available to employers. We conclude the training session and module 4 with an overview of the practices and procedures for handling claims before the Illinois Workers’ Compensation Commission, from the initial inception with the filing of the Application for Adjustment of Claim to the conclusion of the case through trial, appeal or settlement
